Terms and conditions

1. Validity

Unless explicitly agreed otherwise in writing, these terms and conditions of business apply to all deliveries of goods from Ölmühle Johannes Neuhold, which are made remotely on the basis of orders from consumers (within the meaning of the KSchG).

Contract performance on our part (for example: delivery) shall in no case be deemed as acceptance of terms and conditions deviating from our terms and conditions.
If ambiguity nevertheless remains in the interpretation of the contract, these must be eliminated in such a way that the contents agreed upon are usually agreed in comparable cases.

Watch out! These terms and conditions become part of the contract by submitting your order.

2. Contract conclusion

Our offers are completely non-binding. A contract is concluded by sending your order and by our order confirmation or by delivery.
The automatically sent confirmation of the order is for your information and control and does not constitute an order confirmation.
Any deviations from your order must be reported immediately after acceptance of the confirmation by means of a written objection.

We are entitled to accept orders not or only partially. If a refusal of the order on our part takes place, we will make an immediate notification to you.

3. Prize

All prices quoted are in € (Euro) and, unless otherwise expressly stated, include 10% VAT, excluding alcoholic beverages at 20%, excluding delivery costs and without any ancillary services.

For online orders, the prices indicated on the Internet apply. By placing your order you accept the immediately quoted prices and shipping charges.

Deliveries outside the countries of the European Union (EU) may incur additional charges for (export, import and customs) as well as import VAT.

4. Terms of payment, default interest, reminder fees

The buyer agrees to the full payment of the purchase price / wages already at the conclusion of the contract. The payment is therefore by prepayment.
Payments from foreign banks are, within the EU, at no additional charge, if you indicate on the transfer the IBAN and SWIFT code below for our bank details.

In case of late payment, default interest will be charged.
Reminders, collection and extrajudicial attorney fees are at your expense.

5. Withdrawal / right of return

Customers who are consumers within the meaning of the KSchG can withdraw from a contract concluded by distance selling (or a distance contract) within a period of 7 working days. The cancellation period begins from receipt of the delivery of the ordered goods, whereby Saturdays do not count as working days. For consumer customers from Germany, we grant a statutory right of return of 14 days from receipt of delivery. It is sufficient if the resignation is sent within the deadline without giving reasons. Saturdays do not count as working days.
In the case of withdrawal, a total or partial refund of the purchase price will only take place step by step, against deferral of the goods received by the customer.
The costs and risks of the return are at the expense of the customer.
The goods should be returned in unused and resaleable condition and in their original packaging. For items that are affected by signs of use or whose packaging is damaged, we will collect an appropriate fee for the impairment. The same applies if on return of the goods accessories or parts are missing or the return is unfree.

6. Shipping costs

Our selling prices do not include the cost of delivery. This service is provided by us for a separate payment. Weight-based freight charges are charged according to the current, country-specific freight cost table.
The costs incurred will be automatically calculated and announced in the course of the order process.

7. Delivery time

We deliver in the fastest way by parcel service, post or forwarding – usually within a few days. We reserve the right to select the carrier. Please note that the delivery time is dependent on the transport company, we have no influence on it and therefore can not take over an appointment guarantee.
Please indicate any obstacles (eg: absence on delivery day, …) when ordering.

8. Transport damage, complaints

The goods must be inspected immediately after delivery. Any defects found must be reported to the seller immediately, but no later than within 3 days of delivery, stating the nature and extent of the defect. Hidden defects are to be reported immediately after their discovery. Obvious damage / defects please note on the delivery note, only then we can assure you free replacement.

9. Damages, product liability

Claims for damages in cases of slight negligence are excluded. This does not apply to personal injury or damage to property taken over for processing. Any recourse claims against us by contracting parties or third parties under the title “Product Liability” in the sense of the PHG are excluded, unless the person entitled to recourse proves that the mistake was caused in our sphere and was at least caused by gross negligence.

10. Retention of title

The goods remain our property until full payment. A resale is only permitted if we have been informed of this in good time before by quoting the name or the company and the exact business address of the buyer and we agree to the sale. In the case of our consent, the purchase price claim is already assigned to us and we are always authorized to inform the third party debtor of this assignment.

11. Place of performance, choice of law

The place of performance is the registered office of our company in 8422 St. Veit in der Südsteiermark / Draßling 88, Austria.
Austrian substantive law applies. The applicability of the UN Sales Convention is excluded. The contract language is German.

12. Data protection / storage of the contract

We store for processing and execution of your order your address and the order-related data (name, first name, street, house number, zip code, city, e-mail address and possibly telephone / fax number) We are of course committed to a comprehensive protection of your personal information the provisions of the Data Protection Act. In addition, we assure you that your personal data will not be passed on to third parties, but only used by our logistics service providers and for our own marketing purposes.

The respective order is saved and can only be recalled by registered customers after completion. However, it is possible to print the order data immediately after ordering.
